Constitutional Court Repeals Suspension of Sale of Agricultural Land to Foreigners

The Constitutional Court said on June 24 that it found a legislative provision suspending sale of agricultural land to foreign nationals unconstitutional and “repealed” it.

Parliament passed year ago amendments to the law on ownership of agricultural land, imposing moratorium on sale of land to foreign citizens before December 31, 2014.

The provision was challenged in the constitutional court in September, 2013 by an Austrian citizen Mathias Huter, a senior analyst and program manager with Transparency International Georgia, Tbilisi-based watchdog group. 
 
Citing its 2012 decision in favor of allowing foreign citizens to own land, the Constitutional Court said that it ruled against the disputed provision without even hearing the case on merit.
